Ford's record profits in North America in Q4 don't ease anxiety

DEARBORN, Mich.?? Ford is posting record profits in North America, but it's not enough to quell unease about the company's prospects elsewhere.

Ford's shares dropped nearly 5 percent Tuesday after the company said it expects to lose more money in Europe this year and break even in Asia and South America. The final straw for investors: Ford said sales will increase next year but profits should remain about the same, dashing hopes that margins will continue to grow.

The outlook "brings overly optimistic investor expectations back in check," Barclays analyst Brian Johnson said in a note to investors.

Ford posted a record pretax profit of $8.3 billion in North America in 2012, the result of a six-year turnaround orchestrated by chief executive Alan Mulally. It's reaching back into that playbook to fix its operations in Europe, where it lost $1.75 billion. The European restructuring plan announced in October was one reason Ford's stock has been trading at levels not seen since 2011.

But Tuesday, Ford forecast a loss of $2 billion in Europe, and company executives and Wall Street analysts reminded investors that improving the performance outside of North America ? in Europe and Asia ? will take time.

Ford's fourth-quarter profit totaled $1.6 billion, down from a $13.6 billion profit a year earlier. But the profit actually rose by $600 million absent a big accounting-related gain in last year's quarter.

Ford earned 31 cents per share, up from an adjusted 20 cents per share in the fourth quarter of 2011. That beat analysts' forecast of 25 cents per share, according to FactSet.

Amazon. The online retailer says its fourth-quarter net income fell 45 percent, as higher revenue failed to keep pace with increased spending on order fulfillment and digital content.

Revenue, along with revenue guidance for the current quarter, missed Wall Street's expectations ? but investors still sent the world's top online retailer's stock up more than 10 percent in after-hours trading. Amazon said Tuesday that it earned $97 million, or 21 cents per share, in the October-December period. That's down from $177 million, or 38 cents per share, in the same period a year earlier.

Revenue for the crucial holiday quarter grew 22 percent to $21.27 billion from $17.43 billion.

Analysts had expected earnings of 28 cents per share.

U.S. Steel. The giant steelmaker reported a smaller fourth-quarter loss as carmakers and other manufacturers used more steel, and it said shipments should rise in the current quarter.

The Pittsburgh-based steelmaker lost $50 million, or 35 cents per share for the most recent quarter. A year ago, it lost $211 million, or $1.46 per share. Revenue fell 6.9 percent to $4.49 billion.

The most recent loss would have been 41 cents per share if not for a favorable settlement of a contract dispute. The result was much better than the loss of 70 cents per share expected by analysts surveyed by FactSet.

Pfizer. The world's biggest drugmaker's fourth-quarter results easily beat Wall Street expectations, driving up its stock, as profit more than quadrupled, due to tighter spending and a $4.8 billion gain from selling its nutrition business. Those boosts offset competition from generic drugs hurting sales of Lipitor and other medicines.

Pfizer said Tuesday its net income was $6.32 billion, or 85 cents per share, up from $1.44 billion, or 19 cents per share, a year earlier. Revenue fell 7 percent to $15.1 billion.

Academic gains, improved teacher relationships found among high risk kids in Head Start

Jan. 30, 2013 ? A new study by Oregon State University researchers finds that Head Start can make a positive impact in the lives of some of its highest risk children, both academically and behaviorally.

Published in the current issue of the Journal of Applied Developmental Psychology, the study sheds light on how Head Start has helped children living in non-parental care, or living with someone who is not a parent or step-parent by biology or adoption.

"These children tend to have unstable home lives, sometimes transitioning between different relatives, living with their grandma one month, and later with an aunt or other family member," said lead author Shannon Lipscomb, an assistant professor of human development and family sciences at OSU-Cascades.

"These are kids who face heightened risk factors even beyond those of other children living in poverty. They are more similar to what we find in kids in child welfare. They have a lot of challenges in their lives, and the stresses of that can cause behavioral and development issues."

The researchers obtained data from the Head Start Impact Study, a nationally representative sample of Head Start programs and families commissioned by the federal government. Head Start provides comprehensive early child development services to low-income children and their families. That original study, published in 2010, looked at the general population of children attending Head Start programs, but did not examine impacts for children living in non-parental care.

"Children in non-parental care showed more problems with academics, behavior, and a wide variety of risk factors at the beginning of the study," Lipscomb said. "In addition, Head Start is designed as a wrap-around program, which links child, teacher, and parent. So we wanted to know if this model even works for kids who don't have a traditional family, and may have different caregivers at any given time."

The researchers found that Head Start appears to be as beneficial for this group of children as it is for the general population of children living in poverty who attend the program. Analyzing the data on 253 children in non-parental care, they found the program had short-term positive impacts on school readiness, particularly in regards to early academic skills, positive teacher-child relationships, and a reduction in behavior problems.

"Our findings show Head Start is at least as effective for this very high risk group as prior studies have shown that it is for other children," Lipscomb said. "The impact we saw was modest, not huge, but statistically significant. We think the positive impact on child-teacher relationships is especially important."

Lipscomb said this was a new finding; prior analysis of Head Start's impacts on children who live with their parents haven't found this effect.

Lipscomb is an expert on early childhood development, with an emphasis on preschool and early child care experiences, and how those early social experiences help kids prepare for success in life. Her work focuses on children from at-risk backgrounds.

"Children in non-parental care tend to struggle with socio-emotional development, likely due to the risk factors they experience such as transitioning between homes, special needs, and behavioral problems," she said. "Perhaps as a result of Head Start's whole-child focus and standards for teacher qualifications, their teachers may be more effective than caregivers in other types of programs in establishing positive relationships with children who have high needs."

OSU doctoral students Megan Pratt and Sara Schmitt, as well as Katherine Pears and Hyoun Kim of the Oregon Social Learning Center, contributed to this study.

The BenQ MW519 is a likable data projector most fitting for classroom use. Its data image quality, which is best over a digital connection, is fine for typical presentations, while video quality is suitable for shorter clips. Some appealing features include 3D readiness, long lamp life, and several eco-friendly features.

This DLP-based projector is rated at 2,800 lumens of brightness, and has native WXGA (1,280 by 800) resolution. It has large and responsive metal zoom (1.2:1) and focus rings. Its design is simple yet handsome, with matte-black sides and a glossy black top. One downside to the glossy sheen is that it tends to be a "fingerprint magnet," though the prints it collected could be cleaned off easily enough with a cloth. The projector measures 4.4 by 11.9 by 8.7 inches (HWD) and weighs a reasonably portable 5 pounds, although it lacks a carrying case.

The MW519 has a solid selection of ports, including HDMI; composite video/audio; S-video; two VGA inputs to connect with computers and one to connect with a monitor; two audio-in and one audio-out jack, an RS232 jack, and a USB type B connector for connecting with a computer.

Performance
I tested the projector in our studio, doing the official tests in theater-dark conditions but also viewing images and video in varying conditions of ambient light. The image filled our test screen (about 60 inches diagonal) with the projector about 6 feet away from the screen. The image was able to stand up to considerable ambient light without it looking degraded.

I did our data image testing (using the DisplayMate ?suite of projector tests) when connected to a computer over a VGA connection, and then repeated the tests over an HDMI connection. Although in both cases the data image quality was suitable for typical classroom presentations, in several areas the HDMI results were superior.

A strong point over both connections was the MW519's ability to display type that was readable down to our smallest test size. There was slight tinting with both connections, with some white areas showing a hint of yellow, while actual yellows looked dull or mustardy in all color modes.

With VGA, some grays?particularly ones with hatched patterns?looked green in all color modes, although less so in Presentation mode. ?Over the HDMI connection, the grays looked fine, and a slight pixel jitter visible in some textured images over VGA disappeared when I switched to HDMI. With HDMI, it was also much easier to distinguish very light shades of gray.

With both connections, in some bright areas against dark backgrounds I notices the rainbow artifacts frequently seen in DLP projectors, in which little rainbow-like flashes can be seen by people sensitive to the effect, especially when one moves one's head, or in moving images. It's generally less of a problem with data images than with video, and even people somewhat sensitive to it aren't likely to be bothered by it in the MW519's still images.

Video Quality
As is often the case, the rainbow effect was more of an issue in video. Although the effect wasn't unusually severe for a DLP projector, rainbow artifacts were apparent enough in some darker scenes that people who are sensitive to the effect are likely to be distracted by it, making the projector best for shorter clips.

Also effectively limiting the MW519 to shorter clips (or to use in a small room for video) is the feeble 2-watt audio system. It was sometimes difficult to hear, even at full volume, when I sat fairly close to the projector.

The projector has several eco-friendly features that can increase lamp life to as much as 6,500 hours. EcoBlank mode lets teachers easily take a break from a presentation, blanking the screen out and lowering energy consumption up to 70% while paused. The projector will also automatically enter EcoBlank mode after 3 minutes without a signal. SmartEco mode automatically adjusts lamp brightness depending on lighting conditions.

The MW519 is also 3D-capable, with support for 3D Blu-Ray via HDMI,?as well as NVIDIA?3DTV?Play, enabling it to display 3D content from NVIDIA 3D Vision. The active shutter 3D glasses are not included, and can cost up to $70 per pair. One other nice feature is built-in closed captioning for displaying subtitles.

The ViewSonic PJD6553w, also a DLP-based projector with WXGA resolution, is brighter than the MW519 at 3,500 rated lumens. It not only showed very good data image quality, it had better than average video quality for a DLP projector thanks to a minimal rainbow effect, and a more powerful 10W audio system.

The Editors' Choice Epson PowerLite 1835 XGA 3LCD Projector has a slightly higher price and a lower (XGA, 1,024 by 768) native resolution than the MW519, but it's brighter (3,500 lumens), has very good data and video image quality (as an LCD-based projector, it's immune to the rainbow effect), and a loud audio system (though it didn't have the best sound quality).

The BenQ MW519 is a likable projector for classroom use, with good data image quality, especially over an HDMI connection, and power-saving features that can extend lamp life. It's bright enough for use in mid-sized rooms, although its audio is faint. It is 3D capable, but outfitting an entire class with 3D glasses might prove a tough sell to the school administrators. It's best for use mostly with data presentations; there are better choices if video and audio quality are priorities.

Seth Gordon Talks WarGames Remake, Horrible Bosses 2, and More

GORDON:? Yeah, that?s tough.? The thing is, those three guys are so good together, and so much of that movie was unscripted.? We completely riffed and discovered stuff that wasn?t on the page, and I feel like we?d be able to do that again.? I just want to make sure the plot holds up.? That plot of the first one was really good.? You didn?t see that gunshot coming.? You didn?t see some of those turns.?

Canon EOS 6D


Prior to the announcement of the Canon EOS 6D ($2,099 direct, body only) and the Nikon D600, shooters who wanted a full-frame camera?one with an image sensor the same size as a 35mm film frame?were faced with a small number of choices at $3,000 and up. Both companies cut about $1,000 off the price of entry to full-frame with new models that sacrifice some features that pro shooters are used to, but are packaged in smaller bodies that are similar in design to the top-end APS-C cameras. The 20-megapixel 6D also adds some enthusiast-friendly features?notably an integrated GPS receiver and Wi-Fi capability?which, along with fantastic image quality, earn it an almost-perfect rating and our Editors' Choice award. The $6,000 full-frame Nikon D4 is still a better choice for anyone who relies on photography to put food on the table, but most folks simply don't need that much camera in their bag.

Design and Features
While it's bigger than entry-level cameras with smaller APS-C image sensors, the 6D is compact for a full-frame D-SLR. It measures 4.4 by 5.7 by 2.8 inches (HWD) and weighs just under 1.7 pounds without a lens. Compare this with the Canon EOS 5D Mark III, a more traditional full-frame camera that measures 4.6 by 6 by 3 inches and weighs about 2.1 pounds. If you currently shoot with an APS-C Canon camera like the EOS Rebel T4i or EOS 7D and are considering an upgrade to full-frame be aware that while you can mount any EF lens to any Canon D-SLR, Canon's line of EF-S lenses are designed only for use with APS-C cameras and can't be used with the 6D, 5D Mark III, or EOS-1D X cameras. This is in contrast to Nikon's approach, which allows its APS-C DX lens lineup to be used on the D600, the D800, and D4 in a special crop mode. Like Canon's other full-frame offerings there is no flash built into the 6D?you'll need to use an external one. This isn't atypical for a full-frame camera?Nikon does include a pop-up flash on the D600 and D800, but omits it on the D4, and Sony does not include a flash in its full-frame bodies.

The control layout is familiar to anyone who has handled a Canon SLR before. There's a standard mode dial on top left side with an integrated On/Off lever. To the right of the viewfinder you'll find a control wheel, the shutter release, and buttons to adjust the AF Mode, Drive Mode, ISO, Metering Mode, and to activate the backlight on the monochrome information LCD, also located on the top of the camera. The rear controls are compressed when compared with the 5D Mark III, but you'll still have access to a rear control wheel with an integrated four-way controller, an Info button that controls what is displayed on the rear LCD, the Menu button, a control switch to activate Live View and movie recording, image playback controls, and buttons to engage the autofocus system, activate Exposure Lock, and select the active autofocus point. There's also a physical lock switch that prevents the rear control from adjusting settings when turned?that wheel controls exposure compensation in most shooting modes.

First seen on the Rebel series of APS-C cameras, the Q button allows you to change settings via the rear LCD. Hit it and you'll be able to adjust lens aperture, ISO, Exposure Compensation, Flash Compensation, JPG output, White Balance, and other common shooting settings?the rear control pad is used to navigate from item to item and the control wheel scrolls through the available settings.

The camera's large optical viewfinder trumps even the best APS-C models in terms of size and brightness?but it doesn't offer a full 100 percent field of view. Instead Canon opted to include a 97 percent viewfinder?the camera will capture a little bit of extra information around the edges of the frame, and the slightly smaller viewfinder makes it possible to change the focus screen?a feature that was omitted from the higher-end 5D Mark III. This is a boon to Canon shooters who use the rare manual focus Canon lens like the TS-E 90mm f/2.8, or any of the manual focus Carl Zeiss lenses available for Canon cameras like the Makro-Planar T* 2/100, as Canon's EG-S focus screen is ideally suited for accurate manual focus with faster lenses.

The resolution of the 3-inch rear LCD tops one million dots. It's extremely sharp, allowing you to confirm critical focus when reviewing shots or shooting in Live View mode. It's fixed?the Sony Alpha 99 is the only full-frame D-SLR with an articulating display?and isn't quite as large as the 3.2-inch screen on Nikon's D600, but it is sharper.

The 6D is the first SLR with integrated Wi-Fi connectivity, and overall, it's a good implementation. There are a number of ways to use the wireless features, and some are more useful than others. Canon gives you the ability to share photos directly with another Canon Wi-Fi camera and to print directly to a Wi-Fi-enabled printer. So you'll have to be out shooting with a partner who also has a Wi-Fi-equipped Canon camera to take advantage of the former, and the latter assumes that you'll be printing your photos without cropping, retouching, or other post-production work. You also have the option of viewing your photos on a DLNA device, like a Wi-Fi HDTV or set-top box.

The more useful functions involve sharing your photos online, and taking control of the 6D via your smartphone. You can send photos and videos directly to Facebook, Twitter, or YouTube via the Canon Image Gateway service. To set this up you'll need to install the EOS Utility application on your PC or Mac and create an account on the Canon Image Gateway service. From there you can link your social networking accounts. Connecting the 6D to your computer pairs it with your Canon account, and will let you send JPG images and videos directly to the service of your choice. You'll need to be connected to a Wi-Fi network, and the EOS 6D can store the SSID and login information for up to three networks at a time.

Photos and videos can also be directly sent to your iOS or Android device. You can connect to a phone when it, and the 6D, are on the same Wi-Fi network. Or the 6D can act as a hotspot for direct connection?and you can save presets for either configuration in one of the five slots dedicated to this mode. Once connected, you can transfer images and videos directly to your phone via the EOS Remote app; it's available for free in both the Apple and Android app stores. Raw transfer is supported?because photos are sized down to 2-megapixel JPG images in order to speed up transfers. You can also use your phone to control the camera wirelessly. A live feed of the camera's Live View mode shows up on your phone's screen, and you can select a focus point via touch, change shooting settings, and fire the shutter. There's noticeable lag in the video feed?it's not as speedy as the USB tethered computer connection that is possible via the included EOS Utility software for Mac or Windows?but it's useable in the field, whereas traditional tethered shooting is more useful in a studio setting.

You also get integrated GPS. It's a powerful receiver?it only took about 40 seconds to lock on to my location on initial setup?and you can adjust how often it polls for a new location. By default it checks for your location every 15 seconds, but you can go as fast as once a second or as slow as every five minutes. Using the GPS definitely puts a strain on the camera's battery. I was out shooting on a cold morning and went from a full charge to two battery bars in only a few hours. And the GPS will continue to check for your location even when the camera is turned off. The photos I took were, without exception, accurately geotagged, appearing on Lightroom's map at the exact locations from which I shot them. If you want to add location data to your photos, you'll likely want to set the camera to check with the GPS satellites less often to extend the battery life, and disable the GPS before you turn the camera off. If that's an unacceptable compromise, tote an extra battery. There is an optional battery grip available?it plugs into the bottom of the camera and holds two cells, doubling the operation time.

Music, MIDI and mobile? Seen that before, right? Well, yeah, but sometimes something comes along that surprises everyone. Artiphon's Instrument 1 is one such thing. And after all, there's more than one way to crack a nut. Artiphon's method involves creating a high-quality muli-instrument device that uses an iPhone or iPod touch as its brain. So, this is no plastic (bear with us) "appcessory." The Instrument 1 is made out of special quality African hardwood, and centers around an intentionally ambiguous design. There is a pair of high-quality custom speakers that give impressive 30W onboard sound. There is, of course, a line out and MIDI in / out too. The prototype we saw today doesn't have a built-in battery, but final production models will, making this a truly portable, complete solution. Dr Mike Butera, the firm's founder, was keen to explain to us that this is intended not to replicate one specific device (though it does a great job of guitar, violin, banjo and more), but rather to enable musicians to be able to work in a way they want to. The Instrument 1 works with any core MIDI enabled app, but there are plans to release a companion app for more detailed / custom mappings in the future. We got a private tour of the device, to tip-toe past the break for more.

The first thing we noticed was how authentic it felt. Authentic what? Well, ok, that's a little harder to explain. It definitely felt more like holding an instrument, than a MIDI device or an accessory component though. The oiled wood finish, metal speaker grilles and overall quality of the device make it feel like something you'd wield with care. The iPhone section is also pleasantly discreet. Sure, it takes somewhat center place, but at the same time keeps it out of the way when you're playing. Under the neck you'll also find some additional controls that steer the Instrument 1 in more dedicated instrument directions (bass mode for fret tapping, banjo mode with arpeggios etc). The small black box below the iPhone housing serves as a strum-surface (or when in violin mode, the area you "bow"), and the neck section is largely akin to a guitar neck, but when approached creatively, can be used in all manner of ways, such as drum-pads when resting on your lap. For those that want to know, it's currently sporting a 30-pin connector, but has room enough so that you can also use it with a lightning adaptor. There's also a physical volume control and a USB port.

As for the MIDI options... there are plenty. Polyphonic aftertouch, vibrato, versatile modulation and mapping, to name a few. There is an octave switch on the neck, also, so that you can get a wide range of musical notes with ease. Mike showed us that as there are two sensors on each neck-note, you can effectively cram two octaves into the same space too, should this better suit your needs. As mentioned above, currently this is the third prototype, but full production is expected soon. How much, then, does Artiphon want for the Instrument 1? That'll be $800 when it eventually rolls out towards the end of this year. A tall price for a MIDI controller perhaps, but you'll be replacing your entire band at the same time. Just don't tell them yet. Go south for the demo video.

In a statement emailed to reporters Sunday the British Foreign Office did not go into any further detail as to the nature of the threat but noted that "kidnapping for financial or political gain, motivated by criminality or terrorism" was a threat throughout the country.

The new warning comes only days after Western governments urged their citizens in the Libyan city of Benghazi to leave in response to what was described as an imminent threat to Westerners.

2-D electronic devices, may be possible: Fine patterns made with single-atom-thick graphene and boron nitride

Jan. 27, 2013 ? Rice University scientists have taken an important step toward the creation of two-dimensional electronics with a process to make patterns in atom-thick layers that combine a conductor and an insulator.

The materials at play -- graphene and hexagonal boron nitride -- have been merged into sheets and built into a variety of patterns at nanoscale dimensions.

Rice introduced a technique to stitch the identically structured materials together nearly three years ago. Since then, the idea has received a lot of attention from researchers interested in the prospect of building 2-D, atomic-layer circuits, said Rice materials scientist Pulickel Ajayan. He is one of the authors of the new work that appears this week in Nature Nanotechnology. In particular, Ajayan noted that Cornell University scientists reported an advance late last year on the art of making atomic-layer heterostructures through sequential growth schemes.

This week's contribution by Rice offers manufacturers the possibility of shrinking electronic devices into even smaller packages. While Rice's technical capabilities limited features to a resolution of about 100 nanometers, the only real limits are those defined by modern lithographic techniques, according to the researchers. (A nanometer is one-billionth of a meter.)

"It should be possible to make fully functional devices with circuits 30, even 20 nanometers wide, all in two dimensions," said Rice researcher Jun Lou, a co-author of the new paper. That would make circuits on about the same scale as in current semiconductor fabrication, he said.

Graphene has been touted as a wonder material since its discovery in the last decade. Even at one atom thick, the hexagonal array of carbon atoms has proven its potential as a fascinating electronic material. But to build a working device, conductors alone will not do. Graphene-based electronics require similar, compatible 2-D materials for other components, and researchers have found hexagonal boron nitride (h-BN) works nicely as an insulator.

H-BN looks like graphene, with the same chicken-wire atomic array. The earlier work at Rice showed that merging graphene and h-BN via chemical vapor deposition (CVD) created sheets with pools of the two that afforded some control of the material's electronic properties. Ajayan said at the time that the creation offered "a great playground for materials scientists."

He has since concluded that the area of two-dimensional materials beyond graphene "has grown significantly and will play out as one of the key exciting materials in the near future."

His prediction bears fruit in the new work, in which finely detailed patterns of graphene are laced into gaps created in sheets of h-BN. Combs, bars, concentric rings and even microscopic Rice Owls were laid down through a lithographic process. The interface between elements, seen clearly in scanning transmission electron microscope images taken at Oak Ridge National Laboratories, shows a razor-sharp transition from graphene to h-BN along a subnanometer line.

"This is not a simple quilt," Lou said. "It's very precisely engineered. We can control the domain sizes and the domain shapes, both of which are necessary to make electronic devices."

The new technique also began with CVD. Lead author Zheng Liu, a Rice research scientist, and his colleagues first laid down a sheet of h-BN. Laser-cut photoresistant masks were placed over the h-BN, and exposed material was etched away with argon gas. (A focused ion beam system was later used to create even finer patterns, down to 100-nanometer resolution, without masks.) After the masks were washed away, graphene was grown via CVD in the open spaces, where it bonded edge-to-edge with the h-BN. The hybrid layer could then be picked up and placed on any substrate.

While there's much work ahead to characterize the atomic bonds where graphene and h-BN domains meet and to analyze potential defects along the boundaries, Liu's electrical measurements proved the components' qualities remain intact.

"One important thing Zheng showed is that even by doing all kinds of growth, then etching, then regrowth, the intrinsic properties of these two materials are not affected," Lou said. "Insulators stay insulators; they're not doped by the carbon. And the graphene still looks very good. That's important, because we want to be sure what we're growing is exactly what we want."

Liu said the next step is to place a third element, a semiconductor, into the 2-D fabric. "We're trying very hard to integrate this into the platform," he said. "If we can do that, we can build truly integrated in-plane devices." That would give new options to manufacturers toying with the idea of flexible electronics, he said.

"The contribution of this paper is to demonstrate the general process," Lou added. "It's robust, it's repeatable and it creates materials with very nice properties and with dimensions that are at the limit of what is possible."

787 probe far from complete, regulator "very concerned"

WASHINGTON (Reuters) - U.S. safety regulators are nowhere near finishing an investigation into a battery fire on the Boeing Co 787 Dreamliner, a top official said on Thursday, raising the prospect of a prolonged grounding for the aircraft.

Deborah Hersman, chairman of the National Transportation Safety Board, made clear that investigators have found a series of "symptoms" in the battery damaged in a January 7 fire in Boston, but not the underlying cause of the problem. She also said the agency would be looking at the design of the battery compartment area of the plane and whether the certification standards had been strong enough.

The comments were seen by some safety experts within the aerospace industry as a clear signal that this is no longer just a teething issue for the new plane.

That will raise questions about the financial impact for Boeing, which is still running its assembly lines and backing up aircraft to be delivered, and for airlines, many of which counted on getting the futuristic 787 for their expansion plans.

"We are early in our investigation, we have a lot of activities to undertake," Hersman told a news conference.

"This is an unprecedented event. We are very concerned. We do not expect to see fire events on board aircraft. This is a very serious air safety concern."

She rebuffed multiple questions on how long the investigation would take, making clear it could be weeks or more. She also would not say when the 787 would fly again, which is in the hands of the Federal Aviation Administration.

Former NTSB Chairman Mark Rosenker said the briefing made it clear the investigators had come up short in their hunt for the cause of the battery fire.

"It's going to take them longer," he said in an interview. "Weeks, not days."

Richard Aboulafia, aerospace analyst with the Virginia-based Teal Group, said the NTSB briefing was a sobering reminder that investigators have not made much headway on finding a cause for the battery problems.

"It was hard to find a lot of optimism on the call. It sounds like they're still in the middle of a lot of hard work and a lot of mysteries," Aboulafia said. "It just wasn't encouraging. Fire is the last thing you want on an airplane."

NO TIMETABLE TO FLY

The 787 has been grounded worldwide since an All Nippon Airways plane made an emergency landing in Japan on January 16 after a battery incident, which Hersman said may or may not have been a fire.

That emergency landing came after a fire occurred on a Japan Airlines Co Ltd 787 on the tarmac in Boston.

In a statement late on Thursday, Boeing said it was cooperating with regulators and had teams of "hundreds of engineering and technical experts" working on the situation.

"Boeing is eager to see both investigative groups continue their work and determine the cause of these events, and we support their thorough resolution," the company said, adding it was not permitted to comment directly on the ongoing investigations.

Still, Boeing shares are actually up 1.3 percent since regulators said the plane - full of high-tech innovations that are supposed to be a model for future aviation - could not fly.

At least one customer, Poland's LOT, has already raised the prospect of seeking compensation for its losses. Another, China's Hainan Airlines Co Ltd, said this week it was disappointed in the delays and that its expansion plans had been affected as a result.

PUTTING OUT FIRES

Rosenker, the former NTSB official, noted that other new planes had problems when they were introduced, but not fires, which makes this situation stand out.

"Fire is something you don't fool with," he said. "You've got to understand that, particularly given the short period of time the aircraft has been flying."

Boeing has said in the past that, because of their chemical composition, these batteries are difficult to extinguish once they catch fire. As such, the plane is designed to contain fires while they burn themselves out.

Hersman, talking to reporters after the news conference, confirmed that there is no fire suppression system in the area where the battery burned, nor any way to access it in-flight.

Asked if the lack of a fire suppression system in the battery compartment was a design flaw, she said: "We'll certainly be looking at the design and we'll be looking at the certification standards to determine if they were robust enough."

If regulators do decide design changes are needed, that could have implications for Boeing's European rival Airbus and its future A350 jetliner.

"We believe so far we have a robust design, however we will draw the lessons from the 787," Airbus Chief Executive Fabrice Bregier told Reuters Television at the World Economic Forum in Davos.

Billed as Europe's response to the Dreamliner, the A350 is due to enter service next year using lithium-ion batteries, but without the same reliance on electrical systems as the 787, something Airbus says will put less burden on the batteries.

However, Airbus has so far declined to comment on how it would tackle a battery fire if one did break out on board.

DELAYS PERSIST

On Thursday, FAA and NTSB inspectors visited a UTC Aerospace Systems plant in Phoenix, although a company spokesman declined to say what they focused or how long they would be at the plant. UTC makes the aircraft's auxiliary power unit.

Fiona Greig, a spokeswoman for Securaplane, which makes the battery charging unit and start power unit, said its equipment was tested and worked as it should. She declined comment when asked about the issues mentioned in those units by the NTSB.

The 787 program was already years behind schedule before last week's grounding, which means Boeing cannot deliver newly manufactured planes to customers.

That means customers such as United Continental Holdings Inc may have to wait even longer for planes on order. The company's United Airlines already flies six Dreamliners.

"History teaches us that all new aircraft types have issues and the 787 is no different," United Continental Chairman and Chief Executive Jeff Smisek said during the carrier's earnings conference call. "We continue to have confidence in the aircraft and in Boeing's ability to fix the issues, just as they have done on every other new aircraft model they've produced."

Smisek said on Thursday that the carrier still expects to take delivery of two more 787s in the second half of the year.

Boeing has already delivered 50 of the 787s. Around half have been in operation in Japan, but airlines in India, South America, Poland, Qatar and Ethiopia are also flying the planes, as is U.S. carrier United.

The grounding of the Dreamliner, an advanced carbon-composite aircraft with a list price of $207 million, has already forced hundreds of flight cancellations worldwide.

A Necessary Change to the CFAA - Internet Law Blog

As all now know, Aaron Swartz took his own life recently. Common sentiment is that his death was a result of an oppressive federal lawsuit, over a victim-less crime, which would have meant a multi-decade prison sentence for the computer genius if he lost. Congresswoman Zoe Lofgren wants to change the law to ensure nobody else in Aaron?s position feels forced to make the same ultimate sacrifice. So the congresswoman from California introduced Aaron?s Law, an amendment to the Computer Fraud and Abuse Act.

Aaron?s Story: Genius with a Yen for Information

Ever used an RSS feed? You can thank Aaron Swartz for that. As a teenager, when peers were hanging out at the mall, he was creating the RSS specifications. He was also one of the big brains credited with getting Reddit.com off the ground.

Aaron got into some trouble with the government. Without rehashing the long and technical story, suffice it to say that Aaron set up a computer that downloaded a whole lot of data from the M.I.T. JSTOR database. Even though the university declined to prosecute, the government decided to bring him up on wire and computer fraud charges anyway. The Feds wanted to use Aaron as an example of what could happen if you hack or crack networks.

It was a David v. Goliath legal showdown; Aaron represented himself against an army of federal attorneys; he wasn?t successful like David and potentially faced 35 years behind bars. Instead of going to jail, he decided to take his own life.

Zoe Lofgren?s Proposal: Aaron?s Law

Aaron?s death pierced the tech community?s collective soul. Few people doubted that the Digital Age had lost one of its most creative ? albeit melancholy ? minds. Perhaps as a means to cope and honor Aaron?s significant contribution to our times, his passing reawakened a movement to amend outdated Internet law regulations that call for ?outlandishly severe penalties? in victimless online intellectual property cases.

As a tasteful homage to Swartz, Lofgren introduced a bill on Reddit ? a bill that Lofgren explained was written with the intention of preventing ?what happened to Aaron from happening to other Internet users.? She also explained there was a ?simple way to correct this dangerous legal interpretation is to change the CFAA and the wire fraud statutes to exclude terms of service violations.?

Lofgren?s proposal does exactly what Harvard law professor Laurence Lessig has been touting for a while ? it prevents ??crimes? that are nothing more than a breach of contract? from being prosecutable under the Computer Fraud and Abuse Act. Specifically, Lofgren?s law would annotate the CFAA?s definition of ?authorized access? to:

?[Unauthorized access] does not include access in violation of an agreement or contractual obligation, such as an acceptable use policy or terms of service agreement, with an Internet service provider, Internet website, or employer.?

About The Computer Fraud And Abuse Act

The Computer Fraud and Abuse Act (18 USC 1030) passed in 1984 as a way to prosecute high-level computer cracking and espionage. The law was updated in 1988, 1994, 1996, 2001, 2002 and 2008.? As of 2012, the CFAA has been used to combat foreign cybercrimes, computer espionage, computer trespassing, computer fraud, password trafficking and malicious virus spreading. A felony offense, first time offenders convicted under the CFAA can be thrown in jail for 5 years per charge. Defendants convicted twice can receive double the sentence. Currently, the act?s only limitation is monetary in that the action in question must involve a direct cost greater than $5,000.

Since some of the information that lands on ?hacktivist? sites is obtained by cracking and hacking, in recent years the government has attempted to make the CFAA stricter as a way to shut down sites like Wikileaks. Department of Justice Computer Crime Chief Richard Downing claims it will be impossible ?to deter serious insider threats through prosecution? if the CFAA is not made stricter.

Prediction: Who Will Be For Aaron?s Law & Who Will Be Against It?

Now that Lofgren?s bill is on the table, representatives will review the language and get down to the business of ?yay-ing? or ?nay-ing.? Expect push-back from law enforcement agencies and groups that have an interest in mitigating piracy (think RIAA, MPAA and the politicians on their side). The same communities that organized against SOPA, in addition to constitutional advocates on the lookout for statutes with unreasonable punishments, will probably support Lofgren?s proposal.
